1 General provisions
1.1. 2. Entry into force of the purchase and sale agreement

2.3. Each purchase - sale agreement concluded between the Buyer and the Seller (completed purchase with a purchase document) is registered and stored in the WWW.KINDERIS.LT online store database.
3. Buyer's rights
3.1. The Buyer has the right to purchase goods in the WWW.KINDERIS.LT online store in accordance with the procedure established by these Rules and the online store.
3.2. The buyer has the right to withdraw from the contract of sale (purchase with purchase document completed)concluded with the WWW.KINDERIS.LT online store, notifying the Seller thereof in writing (by e-mail, indicating the order number) not later than within 14 (fourteen) days, the term begins to count when the order is delivered to the Buyer or the Buyer picks up the goods and 4.6. in accordance with the prescribed procedure, return the product (s) purchased under the concluded contract.
3.3. The buyer cannot return the goods in the following cases:

3.3.2. in other cases, when the purchase and sale agreement cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.
3.4. Provided for the right of return of goods The buyer can use it only if the product has not been damaged, the packaging has not been damaged or its appearance has not substantially changed, and the product has not been used. Rules 3.3. The right of the Buyer provided for in paragraph 2014 shall be exercised in accordance with the Government of the Republic of Lithuania July 22 Resolution No. 738 “On the Government of the Republic of Lithuania June 2001 Resolution No. 11 “For Retail approval of the Rules ”and Articles 6.22810 and 6.22811 of the Civil Code.

4. Obligations of the Buyer
4.1. The Buyer must accept the goods in accordance with the procedure established by these Rules and pay the agreed amount for them.
4.2. If the data provided in the registration form of the Buyer changes, he must update them immediately.
4.3. The Buyer, using the WWW.KINDERIS.LT online store, undertakes to comply with these Rules and not to violate the legislation of the Republic of Lithuania.
4.5. If the Buyer, at the time of delivery of the goods, refuses to take the goods without good reasons, the Buyer must cover the costs of delivery of the goods.
4.6. If the Buyer decides to refuse the goods of the appropriate quality, he must send or deliver the goods to the Seller immediately and no later than within 16 (sixteen) days from the date of submission of the notice of withdrawal to the Seller. In this case, all shipping and delivery costs are borne by the Buyer.
5. Seller's Rights
5.1. In case of significant circumstances, the Seller may temporarily or permanently suspend the activities of the online store without notifying the Buyer in advance.
5.2. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen the non-cash payment methods, does not pay for the goods within 2 (two) business days.
5.3. When the Buyer chooses the cash payment method, the Seller shall contact the Buyer by phone specified in the order in case of uncertainties regarding the information provided in the order. In this case, the delivery term starts from the date of contact with the Buyer. The Seller has the right to cancel his order without prior notice to the Buyer, if the Seller fails to contact the Buyer within 2 (two) business days.
5.4.WWW.KINDERIS.LT has the right in all cases not to enter into a Purchase-Sale Agreement with a specific Buyer who has placed an order, including, but not limited to, cases where the Buyer has refused the Purchase-Sale Agreement and returned the goods 2 or more times in the last 9 months.
5.6. WWW.KINDERIS.LT has the right to withdraw from the concluded Purchase and Sale Agreement if the stock of goods specified in the agreement has run out, as well as if the agreement was concluded by a person who was not entitled to enter into the agreement in accordance with these Rules.
6. Obligations of the Seller
6.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store WWW.KINDERIS.LT under the conditions set forth in these Rules and the online store.
6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him and under the conditions specified in these Rules.
6.3. The Seller, unable to deliver the goods ordered by the Buyer due to important circumstances, undertakes to offer a similar or as similar as possible in itself. If the Buyer refuses to accept an analogous or most similar product, or the Seller does not have an alternative offer, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if a prepayment has been made.
6.4. The Seller undertakes to respect the Buyer's right to privacy to the personal information belonging to him, specified in the online store registration form, except for the cases established by the laws of the Republic of Lithuania.
7. Prices of goods, payment procedure and terms
7.1. The prices of the goods in the online store and in the formed order are indicated in euros with VAT. WWW.KINDERIS.LT reserves the right to change the prices of goods in case of changes in tax rates, as well as in cases when the manufacturer / supplier changes the pricing of goods.
7.2. The buyer pays for the goods in one of the following ways:
7.2.1. Payment by bank transfer is a prepayment when the Buyer, after printing the order and going to the nearest bank branch, or simply using the online banking system, transfers money to one of the bank accounts of WWW.KINDERIS.LT.
7.2.2. Payment after entering the bank card data (VISA, MASTERCARD, MAESTRO) whether using the banklink service is a prepayment when the Buyer, using the online banking system, transfers money to the KINDERIS.LT bank accountą.
7.2.3. Payment in cash upon delivery of the goods - The Buyer pays for the goods during their delivery (transfer - acceptance).
7.3. When paying by the method of payment provided for in Clause 7.2.1, the Buyer undertakes to pay immediately. In the above-mentioned cases, only after receiving the payment for the goods, the preparation of the consignment of goods begins and the term for delivery of the goods begins to run.
7.4 If the payment (except for the cash payment at the time of delivery of the goods) is received on a business day before 11 am, this day is counted as the first day of order execution. If payment is received after 11 p.m. (yes on weekends or public holidays), then the first day of order fulfillment and delivery of goods is the next working day.
8. Delivery of goods
8.1. The goods are delivered by the Seller or his authorized representative.
8.2. The Seller undertakes to deliver the goods to the Buyer within the terms specified in the description of the goods. These terms do not apply in cases when the Seller does not have the required goods in stock and the Buyer is informed about the shortage of the goods ordered by him.At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to Force Majeure circumstances.
8.3. The delivery price of the goods must be indicated to the Buyer before the payment is made. The delivery price of the goods is paid in advance, together with the payment for the goods.
8.4. Goods are delivered to Buyers in Lithuania and Latvia within 1-3 working days from the order confirmation. Delivery to other EU countries takes from 7-14 days. The buyer is informed about the exact delivery date and time interval by e-mail. by post and / or telephone. The buyer can be individually informed about other delivery times. The Seller does not guarantee that the goods will be delivered in all cases within the delivery terms specified in the Rules and / or elsewhere in the Store, as well as individually specified by the Buyer, especially if the ordered goods are not in the Seller's warehouses. The seller undertakes to make every effort to deliver the goods as soon as possible.
8.5. When ordering the goods, the buyer undertakes to indicate the exact place of delivery of the goods.
8.6. The buyer undertakes to accept the goods himself. In the event that he is unable to accept the goods and the goods have been delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding delivery of the goods to the wrong entity.
8.7. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. If the Buyer has signed the invoice (bill of lading) or other document of delivery-acceptance of the consignment, it is considered that the consignment has been delivered in proper condition.
8.8. In the event that the Buyer withdraws from the sales contract in accordance with these Rules, he shall be obliged to pay all direct costs of returning the goods to the Seller. The amount of these costs of the Seller shall be deducted from the amount of money paid to the Buyer for the goods.
8.9. If it is not possible to deliver the ordered goods in one shipment, then WWW.KINDERIS.LT has the right to deliver the goods in several shipments.
8.10. If the contract of sale provides for the transportation of items and the Seller sends the items to the Buyer, the risk of accidental loss or damage to the items passes to the Buyer when he or a person specified by him, except the carrier, has accepted the items. If the items are handed over to a carrier chosen by the Buyer and the Seller has not offered such delivery, the risk provided for in this paragraph shall pass to the Buyer when the items are handed over to the carrier.
9. Product quality guarantee and shelf life
9.1. All products are covered by the manufacturer's warranty terms. In case of damage to the goods during the warranty period, the repair is performed free of charge (unless there are circumstances provided for by legal acts eliminating the Seller's liability).
9.2. The characteristics of each product sold at WWW.KINDERIS.LT are generally indicated in the product description next to each product.
9.3. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
9.4. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
9.5. The quality guarantee provided by the Seller does not limit or limit the Buyer's rights, which are established by legal acts upon the purchase of goods or services of inappropriate quality.
10. Return and exchange of goods
10.1. Return and exchange of goods is carried out in accordance with the Government of the Republic of Lithuania 2014. July 22 by resolution no. 738 “On the Government of the Republic of Lithuania 2001 June 11 Resolution no. 697 “On the Approval of Retail Trade Rules” and in accordance with the procedure established in Articles 6.22810 and 6.22811 of the Civil Code.
10.2. The Buyer may exercise the right to return and exchange the goods within 14 (fourteen) days from the day of collection or delivery of the goods to him (the term begins when all the consignments of the order are delivered to the Buyer), informing the Seller thereof in accordance with Clause 3.2.
10.3. The returned product must be in the original neat packaging, undamaged by the Buyer, without losing the appearance of the product (undamaged labels, peeled off protective film, etc. (this item does not apply in case of return of defective goods), the same set as received by the Buyer. coupon (if issued).
10.4. Returned goods can be delivered by the Buyer to the address specified by the seller or sent using courier services. In the case of a return goods 3.2. The Buyer shall bear the costs of returning the goods. When the wrong and / or defective goods are returned, the Seller undertakes to pick up such goods and replace them with similar suitable goods. In the event that the Seller does not have similar goods, he shall return to the Buyer the money paid for the goods.
10.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this Article.
11.1. The buyer is fully responsible for the accuracy of the data provided in the purchase form. If the Buyer does not provide accurate data in the purchase form, the Seller is not responsible for the consequences.
11.2. The buyer is responsible for the actions taken using this online store.
11.3. The Seller is released from any liability in cases where the loss of costs arises due to the fact that the Buyer, notwithstanding the Seller's recommendations and its obligations, did not read these Rules, although he was given such an opportunity.
11.4. If the Seller's online store contains links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the non-existent information or activities, does not maintain, control or represent those companies and persons.
11.5. In the event of damage, the guilty party indemnifies the other party for the direct damage suffered.
12. Exchange of information
12.1. The Seller sends all notifications to the e-mail address or sms message provided in the Buyer's registration form.
12.2. The Buyer shall send all notices and questions by the means of communication specified in the "Contacts" section of the Seller's online store.
13. Protection of personal data
13.1. The rules of personal data processing and protection provided for in Clause 13 shall apply to all personal data provided to the Seller by the Buyer or which the Seller collects and processes for the Buyer using the WWW.KINDERIS.LT website.
13.2. The Seller respects the privacy of the Buyer and other visitors of the WWW.KINDERIS.LT website and protects their personal data, which is provided to the Seller and collected by the Seller, as specified in these Rules, which explain why the Seller collects personal data and how to use it.

This personal data will be used for direct marketing purposes only if the Buyer gives his consent by ticking the optional direct marketing method (e-mail and / or SMS). This data is also processed for direct marketing purposes.
13.9. 13.11. Buyer's data for the purposes of selling goods in the WWW.KINDERIS.LT online store is stored and used for 10 years after the conclusion of the purchase and sale agreement.
13.12. The data of the Buyer and other visitors of the WWW.KINDERIS.LT website for direct marketing and administration purposes are stored and used for 3 years from the last shopping on the WWW.KINDERIS.LT website or shorter if the Buyer's or other WWW.KINDERIS.LT website visitors receive a request to refuse to receive direct marketing notifications.
13.13. The Seller undertakes not to disclose personal data to third parties, except for the Seller's partners providing delivery services, the Seller's website or databases, equipment administration, or other services related to the proper execution of the Buyer's order and sending direct marketing offers. In all other cases, any personal data of the Buyer may be disclosed to third parties only in accordance with the procedure provided for by the legal acts of the Republic of Lithuania.
13.14. The Seller shall apply the security and processing requirements established in the Law on the Legal Protection of Personal Data of the Republic of Lithuania and the General Data Protection Regulation of the European Union to the processing of data.
13.15. The seller shall take appropriate technical and organizational measures to ensure the protection of all personal data processed against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, and against all other forms of unlawful processing.
13.16. The buyer has the following rights regarding personal data:
13.16.1. request that the Seller grant access to the data and delete or restrict the processing of the data;
13.16.2. the right to object to the processing of data;
13.16.3. the right to receive personal data in a structured, commonly used and computer-readable format (right to data portability);
13.16.4. the right to withdraw consent;
13.16.5. the right to lodge a complaint with the State Data Protection Inspectorate.

14. Final provisions
14.1. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.
14.2. Any disagreement arising from the implementation of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
